NUVOR TERMS OF SERVICE

OVERVIEW

Welcome to Nuvor.

These Terms of Service (“Terms”) govern your access to and use of the Nuvor website located at nuvor.casa, including related content, features, tools, products, checkout functionality, and services collectively referred to as the “Services.”

Throughout these Terms, “Nuvor,” “we,” “us,” and “our” refer to Nuvor.

Our online store is powered by Shopify, which provides the ecommerce technology that allows us to offer products and Services to you.

By accessing our Website, creating an account, placing an order, purchasing a product, or otherwise using our Services, you agree to these Terms and the policies referenced in them. If you do not agree, you should not use the Services.

Nuvor maintains separate policies concerning privacy, shipping, returns and refunds, product and Website disclaimers, and contact information. Those policies form part of the terms applicable to your use of the Website and purchases from Nuvor.

If there is a conflict between these Terms and a policy specifically governing a particular subject, the more specific policy will control for that subject, subject to applicable law. In particular, our Privacy Policy governs personal information, our Shipping Policy governs processing and delivery, our Refund Policy governs returns and refunds, and our Legal Notice & Website Disclaimer governs general Website disclaimers and product-safety information.

SECTION 1 — ELIGIBILITY AND ACCOUNTS

By using the Services, you represent that you are legally capable of entering into an agreement in your jurisdiction or that you are using the Services with the authorization and supervision required by applicable law.

When creating an account, placing an order, or otherwise providing information to Nuvor, you agree to provide accurate, current, and complete information.

You are responsible for maintaining the confidentiality and security of your account credentials and for activity conducted through your account.

You may not use another person’s account without authorization or impersonate another person or entity.

We may restrict or suspend access to an account where we reasonably believe it is being used fraudulently, unlawfully, or in violation of these Terms.

SECTION 2 — PRODUCTS, PRODUCT INFORMATION, AND SAFETY

Nuvor offers consumer wellness, personal-care, beauty, organization, relaxation, sleep, and related lifestyle products.

We make reasonable efforts to accurately display product descriptions, photographs, colors, materials, dimensions, features, specifications, and other information.

However, actual product appearance may vary slightly because of device displays, photography, manufacturing updates, supplier changes, packaging changes, or similar factors.

Product descriptions, specifications, availability, packaging, and features may be updated from time to time.

Nothing on the Website is intended to constitute medical advice, diagnosis, treatment, or a substitute for advice from a qualified healthcare professional.

Individual product experiences and results may vary. Nuvor does not guarantee any particular health, cosmetic, relaxation, sleep, or wellness outcome unless expressly required by applicable law or stated in a specific written product warranty.

Customers must review and follow all product instructions, warnings, care requirements, and safety information.

Products involving heat, cooling, suction, massage, pressure, electrical power, rechargeable batteries, skin contact, eye-area use, scalp use, or similar functions must be used only as directed.

If product-specific safety instructions conflict with general Website information, the product-specific safety instructions should be followed.

SECTION 3 — ORDERS AND ORDER ACCEPTANCE

Submitting an order constitutes an offer to purchase the products in that order.

An order confirmation or payment authorization does not necessarily mean that an order has been finally accepted or entered fulfillment.

Nuvor reserves the right, where permitted by applicable law, to decline, limit, hold, or cancel an order for legitimate reasons including suspected fraud, payment problems, pricing errors, inventory shortages, product availability, shipping restrictions, incorrect information, unusually large quantities, or other reasonable business or legal reasons.

If we cancel an order after payment has been successfully collected, any amount properly due back to you will be returned in accordance with the applicable payment method, our policies, and applicable law.

We may attempt to contact you using the email address, telephone number, billing information, or other contact information associated with your order if additional information is required.

Customers are responsible for reviewing their order information before submitting an order.

SECTION 4 — PRICES, PAYMENT, TAXES, AND BILLING

Product prices and promotions may change without prior notice.

The price applicable to your purchase will generally be the price displayed during checkout when the order is submitted, subject to correction of genuine pricing or technical errors as permitted by applicable law.

Shipping charges, sales taxes, duties, import taxes, VAT, brokerage charges, or other applicable charges may be additional to the product price.

Charges that can be calculated by our checkout system will be displayed when applicable.

For international purchases, additional government or carrier charges may apply as described in our Shipping Policy.

By submitting payment information, you represent that you are authorized to use the selected payment method and authorize the applicable payment processor to process charges associated with your purchase.

Payments may be processed by Shopify or other authorized third-party payment providers.

Nuvor does not guarantee that every payment method will be available for every customer, order, or location.

SECTION 5 — SHIPPING AND DELIVERY

All order processing, shipping methods, delivery estimates, tracking procedures, split shipments, address corrections, customs issues, lost packages, and packages marked delivered but not received are governed by the Nuvor Shipping Policy.

Processing time and carrier transit time are separate.

Shipping and delivery dates are estimates unless Nuvor expressly states otherwise.

Delivery times may be affected by carriers, fulfillment providers, customs authorities, weather, holidays, order volume, destination, or circumstances outside our reasonable control.

Orders containing multiple products may be shipped in separate packages or from different fulfillment locations.

Nuvor will handle reported lost-package and delivery issues according to our Shipping Policy, available carrier information, the circumstances of the shipment, and applicable law.

Risk of loss and responsibility for delivery will be determined by applicable law and Nuvor’s Shipping Policy. Nothing in these Terms is intended to transfer risk of loss to a customer in a manner that conflicts with those requirements.

SECTION 6 — ORDER CHANGES AND CANCELLATIONS

If you need to modify or cancel an order, contact Nuvor as soon as possible.

We will make reasonable efforts to accommodate requests received before fulfillment begins, but changes or cancellations cannot be guaranteed.

Once an order has entered fulfillment or shipped, it may no longer be possible to modify or cancel it.

If an order cannot be canceled, any eligible return or refund will be governed by the Nuvor Refund Policy.

SECTION 7 — RETURNS, EXCHANGES, AND REFUNDS

All return eligibility, return-request periods, product-condition requirements, exceptions, non-returnable products, damaged or defective products, exchanges, return procedures, and refunds are governed by the Nuvor Refund Policy.

Customers should obtain return authorization from Nuvor before sending merchandise back.

Merchandise returned without following the applicable return procedure may not qualify for acceptance.

Certain products may be excluded from returns because of hygiene, personal-care, safety, customization, perishability, hazardous-material, gift-card, final sale designation, or other considerations described in the Refund Policy.

Nothing in these Terms or the Refund Policy limits a refund, replacement, cancellation, warranty, or other remedy that a customer is legally entitled to receive under applicable law.

SECTION 8 — INTERNATIONAL ORDERS, CUSTOMS, AND DUTIES

International orders may be subject to customs inspections, import duties, VAT, taxes, brokerage charges, or other fees imposed by governments, customs authorities, carriers, or other entities.

Unless expressly stated otherwise during checkout, such charges are not included in the product price or shipping charge and are the customer’s responsibility.

Nuvor does not control customs-processing times or charges imposed by governmental authorities.

SECTION 9 — PROMOTIONS, DISCOUNTS, AND OFFERS

Nuvor may offer discount codes, bundles, sales, free-shipping offers, gifts, or other promotions.

Promotions may have separate eligibility requirements, expiration dates, geographic limitations, product exclusions, purchase minimums, or other conditions.

Promotion-specific terms control that promotion if they conflict with these general Terms.

We reserve the right to reject or correct unauthorized, fraudulent, duplicated, manipulated, or erroneous promotional use to the extent permitted by applicable law.

SECTION 10 — THIRD-PARTY SERVICES AND SHOPIFY

Nuvor uses third-party providers to support aspects of our business, which may include ecommerce technology, hosting, payments, fulfillment, warehousing, logistics, shipping, analytics, marketing, and customer communications.

Our Website is powered by Shopify.

Purchases made through Nuvor’s store are transactions between the customer and Nuvor, not purchases from Shopify.

Shopify and other third parties may provide technology or services involved in processing your transaction, but the use of those services does not remove Nuvor’s responsibilities to customers under these Terms, our policies, or applicable law.

The Website may contain links to third-party websites, applications, or services.

Nuvor does not control independent third-party websites and is not responsible for their separate content, security, availability, privacy practices, or terms.

Use of third-party services may also be subject to the third party’s own terms and policies.

SECTION 11 — INTELLECTUAL PROPERTY

Unless otherwise stated, the Nuvor name, branding, logos, Website design, original written content, graphics, promotional materials, and other original materials appearing through the Services are owned by or licensed to Nuvor and are protected by applicable intellectual-property laws.

The Services are provided for personal, lawful, non-commercial shopping and informational use.

You may not reproduce, republish, distribute, sell, commercially exploit, modify, misrepresent, or create unauthorized derivative works from Nuvor-owned content without prior written authorization except where permitted by law.

Third-party trademarks, product names, photographs, content, and intellectual property remain the property of their respective owners.

Nothing in these Terms transfers ownership of Nuvor or third-party intellectual property to you.

SECTION 12 — REVIEWS, FEEDBACK, AND USER CONTENT

You may have the opportunity to submit reviews, photographs, ratings, comments, suggestions, testimonials, or other content (“User Content”).

You remain responsible for User Content that you submit and represent that you have the necessary rights to provide it.

You may not submit User Content that is knowingly false, unlawful, defamatory, infringing, fraudulent, threatening, malicious, or that violates another person’s intellectual-property, privacy, or other legal rights.

By voluntarily submitting User Content to Nuvor for publication or promotional use, you grant Nuvor a non-exclusive, worldwide, royalty-free license to use, reproduce, display, adapt, distribute, and publish that content in connection with Nuvor’s business, Website, advertising, and marketing, subject to applicable law.

Nuvor may moderate or remove User Content where reasonably necessary to enforce these Terms, maintain the Services, or comply with law.

Reviews and testimonials represent individual experiences and are not guarantees that other customers will achieve the same results.

SECTION 13 — PROHIBITED USES

You may not use the Services to violate law, infringe intellectual-property or privacy rights, distribute malware, interfere with Website security, attempt unauthorized access, impersonate another person, conduct fraud, transmit deliberately misleading information, collect personal information without authorization, send spam, or materially interfere with another person’s use of the Services.

You may not circumvent security, access-control, fraud-prevention, rate-limiting, robot-exclusion, or similar technical measures.

Automated scraping, extraction, or systematic collection of Website content without authorization is prohibited except where such restriction is prohibited by applicable law.

We may take reasonable steps to protect the Website, customers, and our systems against misuse or unauthorized access.

SECTION 14 — PRIVACY

Nuvor’s collection, use, sharing, retention, and processing of personal information is governed by our Privacy Policy.

Because our store uses Shopify and other service providers, personal information may also be processed by Shopify and authorized third parties that provide services necessary to operate the store and complete transactions.

Where these Terms conflict with the Privacy Policy regarding the processing of personal information, the Privacy Policy will control.

SECTION 15 — WEBSITE AVAILABILITY, ERRORS, AND CORRECTIONS

We make reasonable efforts to maintain accurate and available Services, but do not guarantee that the Website will operate without interruption or technical error.

Information on the Website may occasionally contain typographical mistakes, incorrect pricing, outdated availability, inaccurate transit information, or other errors.

Subject to applicable law, Nuvor may correct genuine errors, update Website information, and make appropriate adjustments to affected orders.

We may modify, suspend, maintain, or discontinue Website functionality where reasonably necessary for business, security, technical, or legal reasons.

SECTION 16 — DISCLAIMER OF WARRANTIES

To the fullest extent permitted by applicable law, and except for any express written warranty or statutory warranty that applies to a product, the Website and digital Services are provided on an “as available” basis.

Nuvor does not warrant that Website access will always be uninterrupted, secure, or error-free.

General Website content is provided for informational and commercial purposes and should not be relied upon as medical, legal, or other professional advice.

Product-specific warranties, if any, will be governed by the warranty presented with the applicable product.

Nothing in these Terms disclaims, excludes, or limits warranties, guarantees, consumer protections, or other rights that cannot legally be waived or excluded.

SECTION 17 — LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Nuvor will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising solely from use of or inability to use the Website or reliance on general Website content.

Where applicable law does not permit a particular exclusion or limitation of liability, that exclusion or limitation will apply only to the maximum extent legally permitted.

Nothing in these Terms excludes or limits liability for fraud, willful misconduct, or any other liability that cannot legally be excluded or limited.

Nothing in this section removes any remedy relating to defective products, damaged orders, lost shipments, refunds, statutory warranties, or consumer rights that you may have under applicable law or Nuvor’s applicable policies.

SECTION 18 — INDEMNIFICATION

To the extent permitted by applicable law, you agree to be responsible for losses or claims incurred by Nuvor that result from your unlawful misuse of the Services, material violation of these Terms, infringement of another person’s rights through content you submit, or fraudulent activity attributable to you.

This provision does not require a customer to indemnify Nuvor for Nuvor’s own unlawful conduct, negligence where liability cannot lawfully be excluded, or matters for which indemnification is prohibited by applicable law.

SECTION 19 — SUSPENSION AND TERMINATION

Nuvor may suspend or terminate access to the Services where reasonably necessary because of fraud, security threats, unlawful activity, material violations of these Terms, or misuse of the Website.

Termination or suspension of Website access does not eliminate payment obligations already properly incurred or rights relating to an existing purchase, refund, return, warranty, or other customer remedy.

Provisions that by their nature should survive termination—including intellectual-property, liability, dispute, and governing-law provisions—will continue to apply where appropriate.

SECTION 20 — DISPUTE RESOLUTION AND GOVERNING LAW

If you have a concern regarding an order, product, refund, shipment, or the Services, we encourage you to contact Nuvor first so that we have a reasonable opportunity to review and resolve the matter.

These Terms and use of the Website are governed by the laws of the State of Arizona, United States, without regard to conflict-of-law principles, except where mandatory consumer-protection or other applicable law requires otherwise.

Subject to any rights that applicable law gives you to bring a claim elsewhere, disputes that cannot be resolved informally may be brought before a state or federal court in Arizona that has proper jurisdiction over the dispute.

Nothing in this section prevents either party from using an available small-claims procedure or seeking another remedy that applicable law expressly permits.

These Terms do not impose mandatory arbitration or a class-action waiver.

SECTION 21 — SEVERABILITY, WAIVER, ASSIGNMENT, AND ENTIRE AGREEMENT

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or severed as necessary without affecting the remaining provisions.

A failure by Nuvor to enforce a provision on one occasion does not constitute a permanent waiver of that provision.

You may not transfer rights or obligations under these Terms in a manner that would materially interfere with the operation of the Services without our consent.

Nuvor may assign its rights and obligations as part of a legitimate business transfer, restructuring, sale, or similar transaction, subject to applicable law.

These Terms, together with the Nuvor policies and product-specific terms that apply to your transaction, constitute the agreement governing your use of the Services and purchases from Nuvor.

SECTION 22 — CHANGES TO THESE TERMS

Nuvor may update these Terms periodically to reflect changes to our Website, products, operations, business practices, or legal requirements.

The “Last Updated” date at the top of this page identifies the most recent revision.

Changes will apply prospectively to the extent required by applicable law.

Where applicable law requires notice of a material change, we will provide such notice through an appropriate method.

Continued use of the Services after revised Terms become effective constitutes acceptance of those revised Terms to the extent permitted by applicable law.
